Terms of Service

These Terms of Service ("Terms") govern your use of Swooshare, a file sharing application and service operated by IdeaBridge GmbH ("we", "us", "our"), a company registered in Germany.

By downloading, installing, or using Swooshare, you agree to these Terms. If you do not agree, do not use the service.

1. The Service

Swooshare is a macOS application that allows you to upload files and generate share links. Recipients can download files, leave comments, and reply with files through the share page. The service includes free and paid tiers with different storage limits and features.

2. Accounts and Registration

Swooshare does not require an account to use the free tier. When you first launch the app, a unique device-based identifier is created. If you purchase a Pro or Ultra plan, your subscription is managed through LemonSqueezy and linked to your device.

3. Acceptable Use

You may not use Swooshare to:

  • Upload, share, or distribute illegal content
  • Share copyrighted material you do not have the right to distribute
  • Distribute malware, viruses, or harmful software
  • Harass, threaten, or harm others
  • Circumvent usage limits through automated means
  • Use the service for spam or unsolicited bulk messaging

We reserve the right to remove content and suspend access for violations of these terms. See our Acceptable Use Policy for details.

4. Your Content

You retain all rights to the files you upload. We do not claim ownership of your content. We do not access, view, analyze, or use your files for any purpose other than providing the service (storing, transmitting, and displaying them to your specified recipients).

We will never use your files for training AI models, advertising, or any purpose beyond delivering the service.

5. Storage and Expiry

Files are stored on Cloudflare's global network. Share links expire based on your plan's limits (7 days for Free, 30 days for Pro, no expiry for Ultra). After expiry, files are automatically deleted and cannot be recovered.

If you downgrade your plan, existing share links continue to work until their original expiry date. You cannot create new shares that exceed your current plan's limits.

6. Pricing and Payments

Paid plans (Pro and Ultra) are billed monthly or yearly through LemonSqueezy. Prices are listed in USD. You can cancel anytime — your plan remains active until the end of the current billing period.

We may change pricing with 30 days' notice. Price changes do not affect your current billing cycle.

7. Free Trial

New users receive 7 days of Pro features at no cost and with no credit card required. After the trial, the app automatically reverts to the Free plan. There is nothing to cancel.

8. Availability and Warranty

We aim for high availability but do not guarantee uninterrupted service. Swooshare is provided "as is" without warranties of any kind, express or implied. We are not liable for data loss, service interruptions, or damages arising from the use of the service.

9. Liability

To the maximum extent permitted by law, our liability is limited to the amount you paid for the service in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.

10. Termination

You may stop using Swooshare at any time. We may suspend or terminate your access if you violate these Terms. Upon termination, your files will be deleted after the applicable expiry period.

11. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated through the app or via email (if provided). Continued use after changes constitutes acceptance.

12. Governing Law

These Terms are governed by the laws of Germany. Disputes shall be resolved in the courts of Germany.
